Yibum (Levirate Marriage)
When a man died without children, his brother was obligated to marry his widow to preserve the family line.
In ancient Israelite law, if a married man died without having children, his brother faced a specific obligation: marry the widow and father a child in the dead man's name. This practice, called yibum, served a crucial purpose in a world where leaving no heir meant the loss of family identity and property rights. Although the Torah says the firstborn 'shall succeed in the name of his dead brother,' the Talmud (Yevamot 24a) understands this as a matter of inheritance — the child inherits the deceased's portion and perpetuates his name and estate — rather than literally treating him as the dead brother's son.
Over centuries, as Jewish communities developed and contexts changed, the practice evolved significantly. The early rabbis of the Talmud wrestled with countless edge cases: What if there were multiple brothers? What if the brother refused? What if the widow remarried before the obligation could be fulfilled? Their detailed discussions in the Mishnah and Talmud show how a biblical commandment became increasingly refined through careful legal reasoning. Later medieval and modern Jewish authorities continued to reinterpret yibum, eventually making it less common as other marriage practices and social contexts shifted the meaning of family obligation.
